Welcome to Boletron, an online platform dedicated to selling tickets for various events. By accessing or using our services, you agree to comply with and be legally bound by the following Terms and Conditions of Service ("Terms"), as well as our Privacy Policy. If you do not agree with these Terms, you should not use our services.

At Boletron, our commitment to the Hispanic community in the United States is profound. Therefore, we are not only a platform for selling tickets for performances, shows, and theatrical events. We are also a platform that can be used by educational and cultural communities to promote and distribute tickets for their events. We also offer everything they need at no cost. And that is our commitment to the Hispanic community.

These Terms are designed to comply with the laws of the State of Florida, including those related to ticket sales and resale, consumer protection, and e-commerce. We reserve the right to modify these Terms at any time, and such modifications will become effective immediately upon their publication on our platform. It is your responsibility to periodically review these Terms to stay informed of any changes.

Definitions

  • Platform: Refers to the website, mobile applications, and any other digital services operated by Boletron.
  • User: Any person who accesses or uses the Platform, including Buyers and Sellers.
  • Buyer: A User who purchases tickets through the Platform.
  • Seller: A User who offers tickets for sale through the Platform (applicable if the platform allows resale or third-party sales).
  • Event Organizer: The entity or person responsible for the organization and execution of the event for which tickets are sold.
  • Ticket: A right of entry to a specific event.
  • Event: Any concert, show, sporting event, conference, or any other activity for which tickets are sold through the Platform.

Acceptance of Terms

By clicking "I Agree," "Purchase," "Register," or by otherwise using the Platform, you acknowledge that you have read, understood, and agreed to these Terms. If you are using the Platform on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms.

Ticket Sales and Pricing

Price Transparency: We are committed to full price transparency. The total price of each ticket, including all applicable fees (service charges, taxes, etc.), will be clearly displayed before you confirm your purchase. There will be no hidden fees. This practice complies with legislative trends in Florida that aim to ensure consumers see the final cost upfront [].

Resale Prices (if applicable): If our Platform allows ticket resale, Sellers must strictly comply with Florida Statute ., which states that a person or entity reselling a ticket may not charge more than $ above the admission price charged by the original ticket seller []. Any violation of this law will result in the removal of the listing and potential penalties for the Seller.

Prohibition of Speculative Ticket Sales: Selling tickets that the Seller does not possess or does not have the legal right to sell at the time of listing is strictly prohibited. This includes the sale of speculative tickets, a practice that recent Florida bills seek to explicitly ban []. We reserve the right to cancel any transaction and suspend or terminate the account of any User who violates this provision.

Payments, Refunds, and Cancellations

Payments: All payments will be processed through secure payment methods accepted by the Platform. You agree to pay the full price of the tickets and any applicable fees at the time of purchase.

Refund Policy: All ticket sales are final unless otherwise stated. Refunds will only be issued under the following circumstances:

  • Canceled Event: If an event is canceled and not rescheduled, a full refund of the ticket price (excluding non-refundable service fees, if any) will be issued.
  • Rescheduled Event: If an event is rescheduled, original tickets will generally be valid for the new date. If you cannot attend the new date, you may be eligible for a refund, subject to the Event Organizer's policy.
  • Platform Errors: If a significant error attributable to our Platform occurs that prevents your access to the event.

Refund requests must be made within a specific timeframe, which will be communicated at the time of purchase or in the event's refund policy. Refund policies may vary by Event Organizer, and you agree to be bound by such policies.

Cancellations by Event Organizer: The Platform acts as an intermediary in ticket sales. The decision to cancel or reschedule an event rests solely with the Event Organizer. We are not responsible for cancellations, rescheduling, venue changes, or changes in the cast or content of the event. However, we will endeavor to notify Buyers of such changes as soon as possible.

User Accounts

Registration and Eligibility: To access certain features of the Platform, you may need to create an account. You represent and warrant that you are at least years of age and that all information provided during registration is truthful, accurate, and complete. You agree to keep your account information updated.

Account Security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other security breach.

Account Termination: We reserve the right to suspend or terminate your account and your access to the Platform, at our sole discretion, without prior notice and without liability, for any reason, including, but not limited to, breach of these Terms, fraudulent or illegal activities, or if we deem your conduct to be detrimental to other Users or the Platform.

User Conduct and Prohibited Content

Acceptable Use: You agree to use the Platform only for lawful purposes and in a way that does not infringe upon the rights of, restrict, or inhibit anyone else's use and enjoyment of the Platform.

Prohibited Content: You must not post, upload, transmit, or otherwise make available through the Platform any content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
  • Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
  • Constitutes unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.

Intellectual Property

All content and materials available on the Platform, including, but not limited to, text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the property of Boletron or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not use any of our trademarks or trade dress without our prior written consent.

Privacy and Data Protection

Your privacy is of utmost importance to us. Our Privacy Policy describes how we collect, use, disclose, and protect your personal information. By using the Platform, you agree to the collection and use of your information in accordance with our Privacy Policy. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, BOLETRON DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL BOLETRON, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR ANY OTHER DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, EVEN IF BOLETRON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BOLETRON'S TOTAL LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO BOLETRON FOR THE SERVICES DURING THE TWELVE () MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Boletron, its affiliates, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida for the resolution of any disputes arising out of or relating to these Terms or the Platform.

Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the revised Terms on the Platform and updating the "Effective Date" at the top of these Terms. Your continued use of the Platform after the posting of the revised Terms constitutes your acceptance of the changes.

General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Boletron regarding the use of the Platform.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision shall be interpreted in a manner consistent with applicable law to reflect the original intent of the parties, and the remaining provisions shall remain in full force and effect.
  • No Waiver: Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
